KUALA LUMPUR – The Kuala Lumpur High Court has handed a posthumous victory to People’s Progressive Party (myPPP) president Datuk Seri Maglin Dennis D’Cruz, here today, after dismissing Tan Sri M. Kayveas’ bid to initiate a judicial review to cancel his party presidency.
Federal counsel Muhammad Hairuliqram Hairuddin, who represented the Attorney-General’s Chambers (AGC), said that judge Datuk Amarjeet Singh had notified Kayveas of the rejected application through email, Bernama reported.
Kayveas’ lawyer, Syereen Tang, had also confirmed the matter.
On August 2, the AGC opposed the application for a judicial review. Among the reasons cited was that Kayveas’ raised issue cannot be scrutinised through a judicial review, as it allegedly contravenes Section 18C of the Societies Act 1966.
Additionally, the AGC argued that the court lacks jurisdiction to review matters pertaining to the party.
D’Cruz won the party presidency unopposed in March following the party’s annual general meeting.
Kayveas, 69, filed the application on July 7 last year and named the home minister and the registrar of societies as the first and second respondents.
He contended that the two respondents overlooked the fact that the party’s 67th AGM held on March 19 is deemed null and void as 13 individuals who attended the AGM had their membership stripped, a decision that took effect on April 25, 2018.
Kayveas also claimed that D’Cruz’s appointment had breached the myPPP constitution.
The veteran politician also applied for an order to cancel the decision of a Home Ministry officer through a letter dated April 11, which approved an appeal against the party’s cancellation of registration.
According to Bernama, myPPP’s registration was cancelled on January 14, 2019.
Meanwhile, D’Cruz has been laid to rest at the Cheras Christian Cemetery here today.
After the funeral mass at the Church of St Joseph in Sentul at 10.30am, the cortege made a stop at the myPPP headquarters in Kg Attap here where members draped a party flag over D’Cruz’s coffin.
The hearse was then accompanied by party members dressed in white for a short procession before making its way to the cemetery.
The wake yesterday was attended by several party leaders, such as senior vice-president Datuk Loga Bala Mohan, who is now myPPP acting president, as well as vice-presidents, supreme council members and party members.
It was also attended by other leaders in the Indian community, including former MIC president Tan Sri Dr S. Subramaniam and Malaysian Indian United Party founder Tan Sri S. Nallakaruppan.
D’Cruz died suddenly just after midnight on November 17 after being admitted to Klang Hospital the night before. – November 20, 2023
